Going to get IV but already in the U.S.

I have a pretty odd situation here. My wife and I had IV interview last November in consulate in GuangZhou, China. We passed the interview but they could issue visa until they completed a "namecheck" on us. So we return to US using H1 visa.

Now the "namecheck" is done, and the consulate notifies us to pick it up or have someone pick it up for us. I am planning to ask my parents to pick it up and mail it to us. I have two questoins here I hope you can help:

1. What will happen if the mail gets lost. Will the consulate re-issue the visa, or do we need to start over?? This is my biggest concern. I really appreciate if anyone can help.

2. After we get the visa, can we take the visa to a local INS office to stamp it, or do we have to go through a Port of Entry?

Thanks!

DO NOT GET THE VISAS MAILED TO YOU!!. You will have to travel to your country and RETURN TO USA WITH THOSE VISAS. You will have to surrender the visas at POE and then get admited as permanent residents. That is the only way for you.

Hi nkm-oct23,

Thank you for the reply. If I had to go to a POE, I was planning to take the VISA to Mexico and return to US. Would that be a problem? Do I have to come to the US from the country I got the VISA?

Thanks again!

That might be a possibility but if you lose the visas in mail, you lose a lot of other supporting documents as well and it might be impossible to re-issue the visas. Also I do not know if visas can be mailed outside the country of issue.

Check with the consulate for advise and go with whatever advise you get.

No problem with this. Re-enter at any convenient POE to complete your IV processing.
