Going for CP interview!Help Needed

My I140 is approved on jan\'25 2002 with CP option.My 6 years H1 period is ending on 15th April\'02.Can I go for consular processing interview in May or June ( leaving US on APril 15th) without having H1 validity till interview date? or shall I need to apply for 7th year H1 extension.

It is good Idea to file for 7th year extension .. I know it is pain

I was in same situation.. ask your lawyer ... by law you don\'t need but ask your lawyer ...

cp &7th year H1 extension.

My lawyer says technically u need not apply for 7th year extensions...but he too is not fully confident.What are you doing in your situation?

It is a risk if you don\'t apply

Since your interview date is not yet set, I guess you are making the assumption that you will be getting your interview in May/June. God forbid, if it does get delayed for some reason you will have to basically quit your job as your employer cannot employ you without a valid H1. So, I would suggest you get your extension.

But technically purely from the CP perspective, as long as you are not in US (out of status), you should be ok.
