Hi All,
I have approved I-140(march 2005), I-485 filed (EB2 march 2005), and now retrogressed. I understand ac21 rules. I am a physician and have a great opportunity to go to a fellowship program, however ofcourse it would mean a drastic pay cut, and perhaps also a change in job description(in USCIS eyes), so perhaps won't be justifiable under AC21.
If my employer is ready to play along and this is taken as an extra training to gain skills for the same job before, and employer is willing to provide me a letter of intent to employ once I finish the fellowship, in the same positiion and same job description and wages as on my I 140 petition, is this do-able? Has anyone succesfully argued the above argument( for example, going school/university to get extra qualification, with intent to join the previous employer)?
