Giving Birth on Visa Waiver or B2?

Hi All,

My husband is a green card holder and would like me (his wife) to have our child in the US. I am a british citizen (entering on WVP) providing self funding for payment for the birth and would not require state or federal help and I would not be overstaying. I have no intention of staying indefinitely or myself of my child to become ward of state or to apply for asylum or extension. Neither am I looking for a "back door" to enter the US or any form of long term visa.

We plan on having our child, then leaving as soon as I am able. I have spoken with the hospital administration and they have accepted non-insurance methods of payment and we have already established costs for delivery and stay - and are in-affect treating this a "medical tourism", which is really what it is.
This is where I can apply for a B2 for medical treatment

However before you ask the reason we would prefer to give birth in the US is because it would allow my child to study and live in the US with my husband in the future.
Although i would be covered by the NHS in the UK, health care isn't the best and I am willing and have funds to pay for birth and any complications. Im not looking for Medicare or Social Services to help me.

I understand this is a contentious issue but as I mentioned im not a burden on the state or looking for residency. Any input that you may have would be appreciated as i am concerned that I may be denied entry. Even though my circumstances state otherwise.

Many Thanks

B

I seriously doubt you will denied entry just because you "look" pregnant.
However it depends on when you are seeking entry. VWP allows you 90 days. How many days before your delivery do you expect to fly in? The airline staff may also not let a "very pregnant" woman board.

The airline will let me fly until 34 weeks with a Dr's letter, hopefully thats when I will be flying in. That gives me 6 weeks before my due date and 6 weeks after which i feel is ample.
