Ginnu..approved labor and current job skills different..waiting For Your Response
Hi Ginnu..
My husband filed has an approved labor from his ex-employer with Civil Engineering skills(Contruction,bridges,AutoCAD etc) with PD Oct 28th 2003,EB2. We filed for Premium processing of the i140.
He is currently working with an IT based company(the H1 was filed as a 'Businsess Analyst').
Can he file for the 485 with the ex-employer..? will working with an IT company(Business Analyst) H1 be an issue in the future...?
the attorney has given a G-325A form to be filled out giving the past 5yrs employment history.
excepting for the past 5months on the IT H1(which will be the most recent employment history) the rest of the 4.5yrs he has been working on Civil/Contruction companies..
Can you please suggest how do we go about our situation..After we the EAD can he move back to a civil engineering company and work along the same skills mention in the labor..? I am getting mixed responses..some say we cannot use the AC21 portability..
