Ginnu..approved labor and current job skills different..waiting For Your Response

Hi Ginnu..

My husband filed has an approved labor from his ex-employer with Civil Engineering skills(Contruction,bridges,AutoCAD etc) with PD Oct 28th 2003,EB2. We filed for Premium processing of the i140.

He is currently working with an IT based company(the H1 was filed as a 'Businsess Analyst').

Can he file for the 485 with the ex-employer..? will working with an IT company(Business Analyst) H1 be an issue in the future...?

the attorney has given a G-325A form to be filled out giving the past 5yrs employment history.
excepting for the past 5months on the IT H1(which will be the most recent employment history) the rest of the 4.5yrs he has been working on Civil/Contruction companies..

Can you please suggest how do we go about our situation..After we the EAD can he move back to a civil engineering company and work along the same skills mention in the labor..? I am getting mixed responses..some say we cannot use the AC21 portability..

Pls advice..

---YES he can file I-485 based on ex-employer LC , I-140 attach the copy of I-140 filing reciept or I-140 approval notice. GC is for future job
will working with an IT company(Business Analyst) H1 be an issue in the future...?

-----------------because for AC21 after I -485 pending more than 180 days he needs job offer letter with Same/similar job duties as on his LC

thanks for your time Ginnu..

after lurking for years together in labor forums..I have very little clue as to how this AOS happens..

once we file the 485 + 180 days we can change jobs according to the LC skills. Do we need to send in a letter informing INS that we are doing this change of job..?

So..before we get the Greencard in hand or before we have an interview for the GC is it considered to be safe working with the GC sponsor..? if for some reason we can't get employed with the GC sponsor before the GC interview time any risks involved..?

I read thru the forums that if we r not employed with the GC sponsoring company it will be an issue during Naturalization(not even dreaming of it now..getting thru this AOS maze itself is like walking on thin ice..!!)

please let me know..

it will clear many of our doubts hanging around these threads...
