One of my friend has approved 140 & 485 pending for more than 180 days. He has a valid EAD card which he would need to renew soon.
He needs to use AC-21 with H1-B transfer and his new company has agreed to give him offer letter with same job duties & salary as mentioned on his labor. If he uses H1 transfer will his EAD card be cancelled? If yes then how does he renew his EAD card.

Would changing jobs with H1B transfer in above conditions jeopardise the GC process in any way possible.

Gurus please suggest.

--NO, one can be on H1 and can have EAD also
If yes then how does he renew his EAD card.
---- Fill up the Form I-765 , pay the USCIS Fee+ 2 passport style photographs+copy of earlier EAD+COLOR copy of driving licence+Color copy of passport page that has your name, DOB on it, Copy of I-485 filing reciept+ TOP portion that you got with earlier EAD, mail it to your service center and out side the envelope write in big bold letters : Form I-765 for EAD renewal

--NO, he should get AC21 letter from new employer and update the USCIS. if he is going to join new employer on H1 then he should join AFTER he gets H1 transfer filing reciept from USCIS

---- for EAD renewal H1 approval is NOT needed, he can send copy of I-94, EAD renewal is based on Pending I-485(both the sides)
and
inform about the use of AC-21 ?
----AC21 has nothing to do with H1, once he joines new employer after H1 transfer filing reciept he should sent New employer letter to use AC21+I-485 reciept copy and cover letter that he changed Intent and request should me made to invoke AC21.

H1 and AC21 are independent

*** You can be eligible for AC21 only if I-140 approved and I-485 PENDING more than 180 days( you did not post if your I-485 is pending more than 180 days)

Just helping him out;-)

He has an offer from a fortune 20 public ltd company.The company HR department is not willing to give an EVL(employment verification letter) with the job duties as on his labor, as per the company rules.They say they can only give an EVL with the job title(different than that on labor) and salary.
But his hiring manager has agreed to give an EVL with the job duties on the company letter head.Will that be accepted as EVL for using AC-21.

Also his offer letter mentions the job to be "employment at will" and not a permanent one as required for AC-21.Will that pose a problem.

Please help as he has to reply soon.
