Hello, Ginnu.
I read your lot of replies in this forum.
It is very helpful.

Here is my question:
I have applied I-140, 485, 765, AP in Dec'2004 in EB3 Category.
So far all the applicatiosn are pending.

I want to invoke AC-21 , Can i use AC-21?

I spoke to an attorney, he told it is safe with the new AC-21 LAW, What do you suggest me? Please let me know.

------------ you can use it but it is risky at this time as your I-140 is not approved, play safe

------------ I think what he meant is recent AC21 MEMO. but if USCIS sends any RFE for I-140 and employer who filed does not reply to it then where you will stand?? if no reply to RFE then I-140 cant be approved
What do you suggest me?
------------ I will wait for I-140 to be approved and will not take the risk at this time.
