I was in company A on H1 for 8 months...and then company A transferred us to company B ( Note: the owner of the company B is same as Company A, but different entity, tax-id etc...). Used company A's approved LC... I-140 approved, filed I 485 under company A.....but working for company B now. I have not notified to INS that, I have changed the employer ---- technically...the same employer but different entity as I previously mentioned.

I have my valid EAD, AP's now. would like to visit my country...but I have not intimated about these changes to INS...

1. shall I go on vaction now...without intimating to INS
2. or file AC21 and take the valid papers while visiting to my country

3. Can I file my AC21 by myself.... is so, what are the procedures...

Please, help me!

------ if poosible try to get any letter from comany A employer that company A is closed it is in your intrest(not a must document)

----- you can send employer B future permenent job offer and your intent to work with B after I-485 approval with I-485 filing reciept now or after your visit or when USCIS sends RFE, I will inform USCIS becase they will have the record that you changed to company B and want to use AC21

----- you can go but inform your lawyer if he gets any RFE for I-485 then he should reply the RFE or send email to you. Or you can inform USCIS now. If I-485 was filed 6-9 months back then they are not going to approve I-485 in other 7-8 months and you can update USCIS when you come back( you did not write when your I-485 was filed always write the full case details in steps so other person can understand your case)

------ you can do it or file through lawyer. read the other past threads it has been posted many times.
1 new employer letter for future job offer land on that letter the skills should be same/similar as on approved LC of A
2 your intent change letter
3 I-485 filing reciept

should we send AC21 voluntarily?? or wait for RFE..i know this may be hypothetical

You can send AC21 letter proactively if you want .. Otherwise you can wait till you get an RFE.

if you want to send the AC21 letter then also include a letter from your em,ployer stating the Position/Duties/Salary.

Also attach a copy of your 485 receipt notice.

Could you please post you case details.
 
yeah I am still waiting for D-day to reply

There may be a chance in which I get approval without RFE....so less trouble..after approval..change of intend may have adverse effect
