First let the primary H1 holder get H1 Visa then get H4 or both shold go to Mumbai US consulate same day. I can not post what they will ask, depends upon officer. where is your spouse at present????? did he got H1 through Change of Status in US and has valid I-94 and still in US??? always post full info so that others can understand the situation.

Thanx Ginnu... need some more help...

Thanx for ur advice Ginnu....
I m sorry i didn't post the whole info.....
Here is my situation...
My husband was in US on F1 n myself on F2. After his graduation in May2004 he landed in a job in June, and subsequently filed for His H1 n H4 for depnedent i.e me.
I traveled to India in august with my baby(he is US citizen) while my husband stayed back. We received the approvel notices of H1 and H4 visa's.
My husband didn't get his status changed as yet. His I-94 is valid till duration of study....(D/S).
Now my question is, is it Ok if i go for visa before my husband gets it stamped?
If not then wat is the procedure in this situation?
My husband is trying to come to India for 10 days (not sure), n the scene in Mumbai consulate is u don't get appointment till atleast 30 days after submitting ur docs. So should my husband get his change of status done from canada..... n after that i move forward with my stamping?
I m sooo confused.....
PLZ help...
Thanx in advance

---- when did your husband filed H1?????
was it filed as Change of status from F1 to H1?
Did he file H4 for you as COS from F2, if yes was your H4 approved from F2 to H4 ? did you get I-94 attached with your H4 approval notice????
When did you get your H4 change of status approved??? provide month, did you had H4 approved BEFORE you departed US

My husband didn't get his status changed as yet. His I-94 is valid till duration of study....(D/S).

------confusion..... your spouse filed from F1 to H1, did he got his H1 approved? when he got H1 approved did he get new I-94 attached with his H1 approval notice ( lower right side of approval notice)

Now my question is, is it Ok if i go for visa before my husband gets it stamped?
------- if he is working on H1 status and has H1 approval notice with I-94 attached with his H1 approval then you may go for H4 Visa stamping and you will need his employer letter that he is working with them on H1 status and you will need other documents and his H1 approval notice.
If not then wat is the procedure in this situation?

--- Ranjeet JI,you are confused, what do you mean by Change of status from Canada??? Change of Status is done by USCIS and when he flied H1 as Change of status from F1 what you call this???? was it not change of status filed with USCIS and he got approved OR you may be mixing "Status Change" with VISA Stamp based on H1
**** If he is coming to Bombay better you both get H1 and H4 Visa stamping at same time aur us key saath latktey US aa jao.

n after that i move forward with my stamping?
I m sooo confused.....
PLZ help...
Thanx in advance
