Ginnu!! Is 7th Year ext possible for me

Ginnu or others,

My friends h1-b 6 years expiring in SEP-05. ( same company) ( labor approved long time back)
his I-140 is approved 2 years back. he didn't apply for I-485 as he is not married.

Now his attorneys are saying that USCIS will not extend 7th year because there is a lot of gap after I-140.

Is their attorneys saying true?

---let him file I-485 with copy of I-140 approval and once he gets I-485 filing reciept then he can file 7th year H1 extension with copy of pendingI-485 reciept

---- not due to GAP LC or I-140 once approved is valid,
lawyer may be saying he has nothing pending to be eligible for 7th year, file the I-485 and with I-485 filing reciept file 7th year H1 extension.

*** what kind of logic is this, not filing I-485 becase he is not married, does he think that ONLY married are filing I-485??

thank you ginnu for your reply. he is in CA. If he applies for I-485 and gets approved then after his marriage he cant get his spouse to USA.

So he is waiting to get married so he can apply for him and his spouse same time.

one of my other friend applied concurrently and got his gc approved in 6 months before his marriage. he is married but his wife is in India. thats the logic

------- USCIS is NOt going to approve his I-485 in 3-4 months time many are waiting more than 3 years, I-485 canot be approved without Fingerprint clearence. one he gets FP notice he can postpone FP.

--- may BE under PILOT project and it has been stoped. how many got GC in 6 months???

** he dont want to file I-485 and he also wants 7th year H1 to be filed. I dont see any other alternative for his 7th year H1 extension. let him go to his lawyer.
