Getting ready to File -- Need Help w/ few things

HI all,

I have followed this website for last 1 year. I was under different forms before. I had filed a lawsuit against USCIS to get my wife's citizenship. She was waiting for more than 2 years. Now, we have won and its time for the second step. I am getting ready to file AOS.

I have few questions:

1) Is there a complete list I can refer to check all the documents I will require?

2) My wife will need I-864. Now she was not working in 2003, but from 2004 and 2005 return her income has been well above 125 % poverty line. Do I need to have some else with her for support?

Do I need my income tax returns or not?


3) Some one told me that I need to show proof of marriage other marriage certificate? Is that right? I do not see any form which asked for any proof like utilities bills, etc...

4) I have been married for more than 2 years; will I get permanent green card or conditional one? Do I need anything extra with my application because our marriage is more than 2 years old?

I will greatly appreciate all your help.

1) - just follow the instructions for each of the applications. Make sure you get everything they want, otherwise it'll delay your application.
2) - I don't know. if your work was legal, i'd say file the 864A because more money is better than less money.
3) - You will need proof of marriage other than the certificate at the interview. If you are just filing the application you will only need the marriage certificate.
4) - You don't need anything extra. you will get a permanent greencard! :-)

You can search for the forms to file on this forum and you will find multiple threads explaining the forms to file and purpose of each. In short, you will file I-130, 3 sets of G-325 (1 from your wife for I-130 and 2 from you - one each for I-130 and I485), I-864, I-693, I-765, I-131. The I-765 (Work Authorization) and I-131 (Advance Parole) are upto you whether you need them or not... rest of the forms you must file. Send them all to Chicago lockbox (I know this is gonna be your next question when you prepare the forms)

It is more important how much is she making now... and you don't need the last three year's tax returns any longer. She will need to send only her latest tax return/transcript with the I-864. When you go for the interview, you may take with you the last three year's tax returns/transcripts. As for your tax returns, you won't need them (not at least while filing the application), unless you want to include your income too in the I-864, but since your wife you say is earning more than 125% requirement, you don't need to include your income - hence, you don't need your tax returns

At the time of filing the application the only proof of marriage you need to furnish is a copy of your marriage certificate. The other proofs, eg utility bills, joint accounts, etc are required at the time of the interview. Basically anything that can show that you both have a bonafide marriage and living together would be useful when you go for the interview.

You will get a permanent green card... and you don't have to do anything special for that

2. You don't need to show anything additional if your wife's income is well over 125%. Don't worry about 2003. You don't need to send your income tax returns. I only sent my wife's though I had been making a lot more than her. A lot simpler. You just need to prove that you guys make enough money to support the 2 of you. You can take your documents when you go for the interview just in case.

3. You are just filing an application. You take the proof of the relationship when you go for the interview. You can see a list of items from other posts here on this forum. Don't worry about it at this point. Just send a copy of your marriage certificate and everything else that is required for the application.

4. Like I said, don't send anything else at this point. Take all those things to the interview. You have the interview so you can convince the immigration officer that your marriage is bonafide. If you have been married for more than 2 years, you will be getting a regular GC rightaway and not a conditional one. But you will still need to wait for 3 years before you can become a USC.

One more thing

First of all, Thanks to everyone for replying...

Just one clarification, in this forum, there are sample cover letters.. It is written in I-485 sample that fees of $ 395.00 but it looks like at USCIS website it is 325.00 can some one please verify?

I understand that it might just be a typo..but just wanted to be sure
