Getting Laid off, reverting to F1, can I start going back in school immediately?

Hi,

I was notified that I am being laid off end of this week. From my company attorney and this forum my understanding is that once I am terminated at my present employer I will be out of status as they will withdraw my H1 petition?

I was already continuing education while on H1 and now looking at market situation reverting back to F1 looks like best option. Therefore this will not be a new F1 application but reverting back to F1 for a degree I was already pursuing.

However I am unable to get a clear answer on once I turn in the petition for change of status can I immediately start enrolling at university or do I have to wait till the change of status is approved?

While the F1 application is pending can I still wait in US or do I have to go back and wait for its approval and than join the university?

You have to wait until you get approval, because pending approval you have no status.

Hi rtura, I have similar issue except laid off. I m going to be laid off. If you already got solution can you please help me. and can you tell me how long it will take to change status from h1 to f1? I appreciate your help. thanks in advance.
