Getting laid off - H1 transfer questions

Hi,

I have a 'non-consulting' job with a small firm in NJ. My federal labor should be cleared any day now. Yesterday I was informed that I was going to be laid off due to cost-cutting measures.

I will speaking to them again and will try to get my job extended for some time while I look for another company who will sponsor my H1. The company may or may not continue to process my GC.

Now the question:

I know pay-stubs are important for H1- transfer. However, is it possible that I go on unpaid leave for a 2 months due to a 'family emergency' and apply for an H1- transfer as soon as I get an assignment? I may miss 3-4 paychecks, but will have all the ones until 10/15/2003.

Also, if you know of any leads, please let me know. I have been working as a Senior Web Developer for last few years (total 6 yrs work-ex, of which 4 are in the US).

if there is a gap in service, even if it is unpaid vacation, it is prudent to do a new H1 rather than an extension
