Getting ITIN number for my mother

My mother was with me in US for around 10 months in 2004, on a visitor visa. She went back to India in November.

It is tax time and I would like to claim her as my dependent.

Now, looking at the W-7 application, it is asking that I should submit original, certified or notarized copy of her passport along with the application and along with my IT return.

As she is in India, what kind of procedure needs to be done for passport copy so that is is certified or notarized copy of passport?

Dont you need to have a TIN for your mom ?

I'm in the same boat and need to know how to file this. Have you applied for a TIN for your mom ? or is it not required ? Please pass me whats the procedure for claiming her as a dependent.

I think if they need a notorized copy of passport, She can send it from India (notorized copy). I think they are fine with that.

thanks

I think you can not claim your mom as dependent in visitor visa. Purpose of asking the notorized pp is to verify the visa status. H, L visas are eligible because extended continuous stay in US. For few hundred $, do not get in to IRS problem. IRS is worst than INS.

great guru, you can file your mom/dad as dependent ....

as long as they stay here with you. That is legal. nothing wrong with IRS or INS . its about 500 dollar difference man !

thanks

I am also in the same boat.. From reading on a few sites, I understand that you can claim your mother as a dependant (one extra exemption), then send in your 1040 along with form w-7 & certified pp copy to a different address in Philadelphia, to process the ITIN.. I dont think it really matters on what Visa they were ion.. Somebody, please correct me if I am wrong..

As long as your parents can pass the residency test, you can apply for the tin no. I applied for my parents and got it.

I have also claimed returns on my previous years returns also amending them.
