Getting greencard through US citizen father, what if my visa expires?

Through an immigration lawyer, ive submitted my green card application today. Im a Canadian whos under 21, and my father is a US citizen.

Anyone know how long it will take to process?

Also, i'm currently on an F-1 Student visa. If I were to fall out of status, would that effect my application at all?

Thanks!

If your green card application included I-485 (adjustment of status), you'll be allowed to stay in the US legally until it is decided.

However, once having filed the I-485 you cannot use your F1 visa to re-enter the US, and you must not leave the US until you have Advance Parole or the green card itself, otherwise your green card will be denied for abandoning the adjustment of status process.

Thanks for the response.

I have no plans to leave the US, but if I dont enrole in classes next semester (Jan), I dont need to worry about my application?

Thanks again!

No, once you file I-485 you don't have to keep any status.

In fact, since you are in the immediate relative category, even if you fell out of status before applying that would still be okay.

Depends on how long you've already been attending classes with your F1 visa. If right now is your first semester as an F-1 student, you should continue studying at least part time next semester or you risk getting in trouble for student visa fraud.

Regardless of how long you've been studying so far, if you don't enroll full time next semester, make sure to inform the International Student Office (or whatever they call it) at your school that you've applied for adjustment of status (show them your I-485 receipt) so they can remove you from SEVIS monitoring. Otherwise your failure to enroll full-time could raise alerts with the immigration enforcement authorities.
