Getting GC for a wife of USC

what is the process for petition

HI,
I am new to this forum and very excited!
I am neutralized American citizen and I got married to my husband who is still in home country. I want to start on the petition process, but I do not know what are the forms that I need to file? A friend recommended that I should file a G-325A form. I downloaded the 4 pages form, so should I submit all 4 pages? Does my husband (still in home country) need to file the G-325A 4 page form? And to whom should he submit the form to? Are there additional forms that I need to file? Should I hire an immigration attorney?

I am glad to hear that you have been neutralized so that you no longer pose a threat to society. ;)

Anyway, the key forms are I-130 and I-485. G-325A is only supporting evidence for those forms, but yes you need to fill out all four pages. You need one for you and one for your spouse to accompany form I-130 and then another copy for your spouse to go with form I-485. If you use the fillable PDF form, then you only have to fill out the front page and the other pages will be filled out automatically.

Read the instructions for form I-485 to get started. It will tell you what other forms to include as well (I-693 for medical exam, for example).
 
Should I file a I-130 or I-129F

Thank you very much for the prompt reply. Now, I feel a lot better about the scary process. I have few additional questions and I hope you will not mind replying. Should I file I-130, Petition for Alien Relative, or I-129F petition and receive K-4 visas. Please help!

hahahah... neutralized... ROFL. My wife had to kick me hard to make me stop laughing. I know you meant naturalized, but i cracked up. :D... Ok. serious face. Zara, you can opt to go for the Consular processing route or the K visa for your husband.

Also, you CANNOT file I-485 if your husband is not in the US.
 
Thank you for replying so promptly. I will go through the website for the medical exam. Basically I was confused about the 1-485 form but I gathered that this form has to be filled by everyone. So I guess that is answered. I am in the process of filling up all the forms and if I am in doubts will post you some more questions.

Thank you for your very kind reply and correction. I have additional question, I know that my husband and I have to file the 4pages G-325A forms. On the G325A form there is a question that have the following options:
“This form is submitted in connection with application for”:
Naturalization
Status as permanent resident
Other(specify) :
I know that my husband will check off the box for Status as permanent resident, but I am not sure what option should I check off. I think I should choose the “Other” option and write, “Petition for Alien Relative” please reply soon. ( I took off a day from work to complete the forms) Please reply soon.

Qim, they take a while to correct the name on your application, if they ever do. At least, that was my experience. Like you are saying, I tried to get it fixed when I went for my FP appointment. They did in fact correct my last name in the system while I was there. But I still got my EAD with the last name misspelt (It was my EAD receipt that had my last name misspelt). You probably want to do everything possible. Talk to the people at the FP appointment place (normally, it is outsourced, so these people don't directly work for USCIS, so they are nicer too :-D), follow up with USCIS after 30 days if you still haven't gotten a notice from them saying that your name was corrected, and also remember to mention this to the IO who interviews you. My wife had FP appointment yesterday and tried to correct the USCIS misspelling of her name, however she was told that they had no power to change anything in main computer and thus had to use same misspelled name as on FP notice... We still didn't get any notice from USCIS, I guess we wait 30 days (will be on 7/14) and if nothing then go to InfoPass, see if they can do anything...
 
Don't know if my experience will help. But you can take a look at my timeline under my signature and estiamte how long it will take you to get the card (things that are similar to your case: my wife is on F-1. I upgraded my I-130 petition after becoming a citizen. The I-130 petition was transferred and processed at California Service Center.) My previous posts on the process may also help.

My I-130 petition was mistakenly sent to National Visa Center so we did not get the approval stamp after our sucessful I-485 interview (even though the officer knew our I-130 has been approved. She needed the actual case file in hand). It took us additional two months to get the actual card (just a few days ago.)

Because we did not get the passport stamped, we specifically asked the interviewing officer whether my wife should continue to maintain her full-time student status (the officer had already congratulated us.) She said "Yes, definitely! Maintain whatever status you are now until you get the card." We did that just to be safe.

Very fast interview notice ... name remains incorrect

Yesterday, we received the AOS interview notice (for 8/23), it came a lot faster than expected. Very good news.

Unfortunately, my wife last name remains same wrong. We will be waiting until 30 days after she called USCIS (6/14) and if nothing then probably try INFOPASS.
