Getting a promotion before 180 days

Do you think it is wise to accept a promotion in the same company before 180 days are over? I know for sure that I-485 will be pending for more than 180 days so why bother waiting for a long time to get 20% more in salary if I meet AC21 standards ("same occupation", valid I-140 etc).
 
I would if I were in your shoes! I don't think a higher position, in the same line of work as mentioned in I-140 and with the same company, probably even the same location would be considered a questionable move by INS!


3% of the 20% increase paid to me for the above opinion/advise would NOT go unappreciated! :) :D :D

There are two types of promotion.

If it is a similar job, then the fact that it is less than 180 days after the RD is irrelevant. If it is not, then AC21 is of no use to you. Compare your new/old duties, title and pay. If it's similar, then you should be OK.

The position is changing from Senior Dev Engineer to Staff Dev Engineer (manager level). It also may require relocation to a different state in a couple of months. My lawyer says that I need to use AC21 even if I don't move anywhere since the new position is different from the one on my LC.
