I was recently told by a friend of mine about getting 1-year extension after completing 6-years of H1B.

I am on H1B visa, and it expires (6 years) in Aug2003. I have not applied for my GC or any other. I have less than 10 months to go. Currently i am working for Public Sector and they hold my H1B. So in that case can i get 1 year extention(s) by getting my H1B renewed. If so .. how is it possible. Is there a special criteria or something. Is there any online document or information ....

all and any leads are really appreciated !!!!!!

thanks

The only way that I am aware of that you can extent your H1-B stay in 1 year increments is if you have applied for labor certification for GC purposes and it has been pending for more than a year.
There maybe other ways to - have you tried to consult a lawyer?
Good luck

I agree with the above. You basically have 3 choices:

1. Find a way to file for an extension based on you not actually reaching 6 years in the US. File for the extension and file an LC ASAP.

2. Change to another status (O-1 for example) if available.

3. Leave the US.

The only other option would be to file an I-140 and I-485 simultaneously by either substituting in for another alien with an approved LC or filing for an NIW or EB-1.

Yes, You are real Sufferer!!

Hi
After 6th year, you suppose to go back to your home country?

Why, simple, You never applied your green card?

Now, it is too late. Your EDD must be atleat 1 year old or I140 is one year old.
Do you know one thing, your Govt h1 sponser no need to sponser you in this case, any comapny can put your Labor Cert (EDD) while you are in a different company h1.

Go back come again after a year, or try job in CANADA,

God Bless you.
