Get RFE for I485 and I140 no changes

Friends,

I need your suggestions for my intertesting situation.

I just got email from USCIS ask RFE for my and my wife's I1485. But the I140 status keeps the same

I140/485 RD:10/17/2003
FP: 01/20/2004. My wife did twice 01/20/2004 and 03/01/2004 (the first one is not good enough)
AP: 02/15/2004
1st EAD :12/16/2003
2nd EAD: 01/09/2004
EB3

I just sent email for name check last Fri. (11/05/2004)

Two of my co-workers and I filed I140/485 on the same day.

One got both approved on 09/30/2004 and he got card already
One got I140 approval on 11/04/2004. No news on I485

What is the RFE for? Is it possible for Pay Ability or work experience? I got my degree in USA

Since you said the 140 status is not changed, I am wondering if that could be related to your Medicals/Birth Certficate/Marriage Certficate etc. Even Education might be the reason....
Just a thought though.....

I will keep you guys posting. My company was sold on 04/30/2004 and my dept was sold again on 09/25/2004. It is a little complicated.

I just worry about Employment Status RFE.
 
I have noticed on this forum that the status of I-140 did not change for some of the guys even after approval.

If your I-140 is already approved, then the ref on 485 could be an easy one.

Is there any change in your I-140 LUD ?
What is the present LUD on your I-140 ?
 
My I-140 LUD is changed to the same as 485's (11/08/2004)

From 10/17/2003 till today, LUD of my 485/140 only changed once due to my address change

Hope that USCIS approved my I140

I am guessing that USCIS works/issues RFEs for I-485 only after they are done with I-140.

I do not remember like receiving RFEs for both I-140 and I-485 on one case at the same time.

Or

Receiving RFEs for I-485 without USCIS first completing the processing of I-140.

Please post if any body had any other observations.

Yes you are definitly right. My 140 and 485 's LUD are both changed to 11/09. 485 shows RFE is requied and i140 is pending. Today my lawyer got the approval of I140 and RFE of 485 which is for Medical Check. The I140's approval date is 11/09 a day ahead LUD (LUD was changed on 11/08 and 11/10)

BTW for my co-worker, whose online 140 status showed approved and 485 pending on 11/04, but both LUD are 11/04. He received 485 approvals (wife and himself) today. The approve date is 11/04

So I think
1. If both 140and 485 LUD are changed and 140 is approved, I485 must be approved
2. If both 140and 485 LUD are changed and 485 is RFEed/Approved, 140must be approved.

BTW, all of our three have first asked for name checking and then cases are approved or RFEed. The name checking might trgger something

I think when processing date is near your I-485 ND, you can send email for name checking. Otherwise INS will not touch your case if too early
