Genuine Quick Help Needed in deciding between K1/K3??

Dear All,

I need Help. We had a family ceremony and plan to marry. But I am very confused which step to take. This is my second marriage and since after having gone through a divorce i dont want to make any more mistakes. It is indeed very hurting. My parents dont want anything to be done illegally.

I am from India. I have a 10 yr visior visa stamped.

Please suggest a Safer + Faster +No RIsk Route .

Option 1: Let USC apply for K1, Once it comes then we get married in USA.
Option 2: Get married in India and Apply for K3.

Q1) Is one allowed to enter US On visitor visa once K1 is applied? Can one get entry at POE?
Q2) Is one allowed to enter US On visitor visa once K3(I-130) is applied? Can one get entry at POE?
Q3) How much time is it taking for K1 to get approved?
Q4) How much time is it taking for K3 to get approved?
Q5) Is it recommended to wait on K1 and not apply K3 ??
Q6) Is it recommended to apply K3 if and only if it is taking same time?
Q7) Are there any complications involved in K1 or K3?

I am confused and I need to decide by 1st Oct. Please SUGGEST.

bonafide certificate....

hello all,

i was looking at procdure to follow for K1/ K3 . K1 seems simple, in K3 one has to provide bonfide certificate...

it talks of joint accouints, property..etc..

If a USC gets married in India and leaves for USA. How do we establish bonfide certificate?? What is a MUST that ONE HAS to provide as a document to fullfil this requirement?

Is K1 and K3 taking same timelines??

I request all to PLEASE help me resolve my concerns, based on today;s timelines and realities.

K-1 is much faster

Go the K-1 route. You will save about 2-3 months. You do need to apply for the Adjustment of Status after marriage and it costs $1010 for adults, and $600 for children under the age of 12. I'd only use the K3 if I was already married had no other options.

1) Yes, though entry is not guaranteed. If you are going to visit, just be mentally prepared for a denial of entry (though denial is unlikely, it is certainly a possibility).
2) As above.
3) Petitions sent to Vermont are getting approved in approx 114 days, and those sent to California approx 105 days. Once the petition has been approved, it is then sent to the appropriate consulate where the beneficiary will be interviewed- the time between the approved petition being sent and the interview date varies between country and consulate. So on average be prepared for a 6-10 month wait (though could be more/less- each case is different).

4) Petitions sent to Vermont = approx 191 days.....California = approx 74 days (which seems crazily low, but these figures are based on real people's petitions).

Then once again, as with the K1, there is the time to wait for interview, so be prepared for a 8-12 month wait if filing through Vermont, and less if through California (though could be more/less).

On a side note though- if you are going to go via the spousal route then I would forget about the K3 and instead go for the CR/IR1 visa - much better than the old K3.
