Hello everyone,

I've recently joined the forum and this is my first post. I'll try avoid asking questions that I've already seen answered before, some will probably sound similar but they are more specific to my situation, I think.

Sorry if this is long.

I know that it's been a long time since then and it's a bit late to ask some of these now, but I just need reassurance.
Regarding the forms that we all sent to KCC back in May, DS230 Part 1, Question 10 asks to put down an address in the US where you intend to live, if known, which I put down as 'N/A' because I don't. However in Question 11 it asks to provide an address in the US where you would like your Green Card mailed, it doesn't say 'if known' but I put it down as 'N/A' as well. Is this okay? Will I be able to choose an address if my interview is successful? Or am I screwed haha. :rolleyes:

At the beginning of Part 2 on the same document, it asks to provide Family Name, First & Middle Name again, so I put down my details, however underneath it says 'Name and Address of Petitioner' & Tele number and e-mail address, all of which I put down as 'N/A' ? :S Please tell me this is no big problem haha.

Also, on the 1st form with only 2 pages, at the top of the document it says 'Expiration Date: 03/31/2013', I downloaded it from the official travel.state.gov website as soon as I found out I have been selected in May. I'm guessing they didn't get to update it at the time, but I'm assuming it shouldn't really be an issue? Is it?

Lastly, if my documents are found to be all fine and eligible by KCC am I definitely going to have my interview? What are the chances I don't based on my forms? My Case Number is 2014EU00014XXX, from what I've read this is pretty low and I'm guessing the interview would be around Jan/Feb time?

Once again, sorry for the question overload, I know it's a bit pointless now as I left it so long, I'm just starting to panic as it's getting closer and closer to the possible interview. Thanks for your time and I appreciate any reply this gets :D :o

You will need to provide an address for this, and if I'm not mistaken they want something by the interview. You're not held to it though as you can change this address at the port of entry.

It's correct as for DV there is no petitioner.

Not an issue. I also sent in an 'expired' form and I currently have an immigrant visa in my passport :)

Once you have been selected, even of your forms are incorrect you will be scheduled an interview, as long as your number is current. KCC cannot determine ineligibility to receive a visa, only a consular officer can do that.

Actually, you, the main selectee, are the petitioner and you should have put down your information on that section. Having said that though, putting 'N/A' will not invalidate your forms or cause any issue at the time if the interview.

I've seen guidance on this somewhere, either N/A or "self" are fine. I seem to recall that technically there is no petitioner for a DV winner, as a petitioner is someone who files an immigration application on your behalf.

A petitioner could either be yourself or someone else making a petition on your behalf depending on the type of application it is. When one applies for a B1/B2 visa for instance, the person is self petitioning, which will make the applicant the Petitioner.

Dv based GC applications are self-petitions. The DOS Foreign Affairs Manual 9 FAM 42.33 N5.2 talks about the "Petition/Application Validity" of a DV based GC application. It says in part:

The petition is valid until midnight of the last day of the fiscal year for which the petition was submitted

IMO, there can be no petition without the existence of a 'Petitioner', which makes the DV winner/selectee the "Petitioner" when he/she fills out the DS-230 form.

Hmm...ok, I'll see if I can find (tomorrow) the reference I had used. For our forms I put N/A on mine and me for the derivatives, and that was as a result of some research into it.

Edit : this sentence implies there is no petitioner, as a start - what I recall was more detailed :

IMO, based on the numerous official sources I have come across in the past, statements such as "unlike other immigrant types, Diversity Visas (DV) do not require a U.S. sponsor, and therefore a petition is not needed" on the US government websites are blanket statements intended to mean "pre-approvals" such as filing form I-130 for example, are not required for DV. It does not mean the the DV selectee/winner is not the petitioner or self-petitioning.

The INA, (Immigration and National Act) which is a collection of statutes governing the US immigration process refers to a DV based GC application as a petition, it is the basic body of immigration law and that is what I go by.

We can agree to disagree on this.
