GC spouse based I-130 approved in 2 yrs??

Hi Folks,

A quick note: This forum has been immensely helpful to me till now, and wanted to say thanks to everybody involved.

Now to my current situation. My wife, a GC holder filed my I-130 in Jan 2003 in TX, which was later moved by the INS to CA processing center. Then I switched jobs to the east coast and filed a change of address with INS, assuming they would move the petition to Vermont processing center(this happened about 2 months ago).

Today I got an email from USCIS, saying the "This case has been approved. On April 6, 2005, an approval notice was mailed...." :eek:

Does this really mean the petition has been approved or is this thier way of saying we have changed processing center or something. What the hell do I make of this? :confused: I know from the INS montly bulletin that the current priority date is about Jan 2001. I can't believe that my case was approved and am fearing that this is something else and a beginning of a bad thing.

What do you guys think? You guys heard of anything like this before? Any comments/suggestions/questions for INS phone rep would be very welcome and greatly appreciated...

I have file I130 for my husband back in September 2002 with Nebraska Service center. Then I moved to South and I filed change of address. So now my file is with Texas Service Center. But it is not approved yet. Wait till you get the hard copy of the approval.
 
Yes, is true your petition has been approved. The dates that appread on the USCIS website are the dates of the backlog case USCIS is currently working on.

Now, I have a question for you. What country are you from sir if you don't mind me asking?
 
Even though your I-130 is approved, you will have to wait ( for several years) until your priority date becomes current in order to apply for adjustment or to get an interview at US consulate.

To answer an above question, I am from India.

Now, I understand the part where I cannot apply for I485(adjustment of status) unitl the Visa number becomes available.

But can I apply for EAD(work authorization) and would I get it??
 
Thanks for answering my question Fornehal. Now, I don't think you will be able to apply for an EAD card as of yet. In order for you to be able to apply for one you must have an I-485 pending. Another thing I wanted to tell you is that USCIS is processing I-130 as visa numbers become available. Now, I don't want to get your hopes up, but you may not have to wait for a visa number.However, don't take my word for it, you should contact USCIS and ask them.
 
Visa Numbers and priority date being current is the same thing??

I got the approval in the mail(to the old address and not the new one).

My I-130 is approved. But my priority date(Jan 2003) is still not current(current dates are Jan 2001). Does this mean that, when my priority date becomes current, that's when the Visa number become available and then only can I file for my I-485 and I-765??

Please let me know. Also if bear with my relative ignorance in this immigration matter. I cannot ever get my head wrapped around this :confused:

You are really lucky that they actually approved your case before visa number becomes current for your priority date. Which is the opposite of my case. My wife's priority date has become current for 3 months now, and the I130 which was filed in 1/2001 is still pending at TSC. Can anyone tell me
1. Is this common?
2. What are my options?
