Hello All,
My mother got her B2 visa last year, stayed like a year with me (applied for extension). Left like last week back to India. So, I was hoping to get her back in next couple of months on her B2, and then after my citizenship, apply for her GC while she is here. She has ten year visa(B2).
I am still very confused as to what to do.
Please help.
Thanks,
akapoor
Bad plan. At "10yr" B-2 visa only entitles the holder to stay at most 180 days in a single visit unless an extension has been granted. If there is an extension, it will be at most an extra 180 days, after which the visa holder must leave the US. Further re-entry to the US is entirely at the discretion of the CBP officer at the PoE, and even then, there is a significant likelihood of only being given a short authorized stay (e.g. 30 days) if the time between trips is considered too short.
Be aware there are also IRS implications for a non-resident being physically present in the US for more than 185 days per calendar year. Put simply, if you stay too long, you'll be subject to income tax!
