I married a USC last year in June. We had our interview for the GC this March, but my background check is still pending. My grandfather passed away at home and I would like to go home to show support for my family. I might actually stay home for a few months to help my parents a bit.

When we filed for the GC, we asked for the travel documents. I also received my tamporary work permit (valid until the end of December). I have been working in that one since now.

How can I travel home for a few months and not get into trouble for it? There has to be a way to deal with these kinds of things.

Thank you!

first thing first, have you put in for a work authorization replacement? if not, do it.

as for travelling. were you here illegally before the marriage? if so, good chance that despite the fact they will give you permisison to leave and come back, that they will not let you in. stupid idea since they are giving you the permission, but is possible.

No I have not done that yet. As I mentioned my current one runs out at the end of December, so I didn't think I would have to.

I did have to quit my job though, because I need to leave for a longer period. I am not sure if this is going to cause problems later on.

I have never been in the US illegally. My status was always clean and legal.

as far as i know, people need to put in for a new one six months before the old one expires. as for leaving, you should be fine then.

I believe for you to travel all you need is AP- Advance parole since you did not over stayed your pervious visa but I do not know how long you can stay away for using it.
I will suggest that you don't stay too long since anything can come up with your application while you are away

Even with the GC card I learnt that you cannot stay outside the US for more than 6months

Good luck
