Hello Forum:

I have a question.
I am a US Citizen. My husband had an asylee status when we got married. But he got his green card(adjustment of status) through marriage and NOT through asylum.

Can he travel back to his home country with this green card status? and also can he travel back to his home country after US Citizenship?

Thanks a lot

This is tricky. His green card does not carry AS-6 or AS-8 code. However CBP/ICE knows (or can quickly find out) that he was an asylee. So visiting COP may still be an issue. It is a judgement call in my opinion.

As triple said, this is really tricky. This is just my understanding of immigration law and it may or may not relate to him, he can be denied any immigration benefit if he lies or has lied to authority to seek any immigration benefit in the past and any current benefit will be revoked. Now the question is that if he lied in his asylum case for any benefit and if be subject to investigation and if proved, he might be in the hot seat now or in the future specially when apply for citizenship. Again that is my Prediction and hope never happen to him.I would wait for citizenship which should not be far away since he is married to USC.

Another factor could be if there has been a drastic change in the COP and the asylee no longer fears for his life. In such a case, visiting COP may not be an issue.

Of course, whether USCIS will agree with that statement is another matter. Some countries have obvious changes like that (e.g. Russia today vs. Soviet Russia in the 1980s), but others are not so clear.
