GC in Process, expecting a baby

485 is in process for my wife and I. Filing date is end of 2002. My wife is expecting.We would like to have a baby in India. We will not be h1/h4 at that time. How can you get the baby into the US.
Can I apply for 485 for the baby after its born and travel with a AP?.
Your thoughts please?.

-----You and your wife need AP, you should apply immediately

--- If the baby is born in India then baby needs AP but he/she can’t get AP as AP can only be applied from US when he/she is in US. He/she will be admitted on H4 if you have valid H1b and maintaining it,
Your thoughts please?.
---- Best option: Maintain H1 or get new H1( if EAD used) by premium processing, go out get Visa stamp and enter on H1B status that way your wife and baby will get H4 visa based on your H1 and once child reaches US file his/her I-485

And just in case you did not know, I believe the child can decide to retain either Indian or US citizenship when he/she becomes 18 or maybe it is 21... Unlike popular mindset, US does not offer dual citizenship, so even if India sets up dual citizenship, it is not that useful.

Evenif US does not offer dual Citizenship, India offering Dual is still useful. The way to do is ONCE YOU GET US CITIZINSHIP Give up Indian Passport & Get US Passport ...& then apply to Indian government for Indian Passport again as Dual Citizen.
 
US actually does not actively enforce the multi-citizenship laws, but you never know when the next "Bush's wave of stupidity" (tm) aka "War on Terror" (tm) comes along and rounds up the hapless people into the depths of US jails without any respect for human rights.

Give your baby a better opportunity

Have your kid here!!! in US


He can always choose latter whether he want to take up Indian Citizenship latter


Just my opinion...............................................PLease ignore it if you don't like it, and I don't know the circumtances behind your decision

Plus, if the baby is not born here, s/he will not be able to run for President. S/he may hate you for it one day....
 
If AOS is over - you will have to apply for V- Visa. Else you can apply for 485 for your kid. Hope it helps.
