GC holder sponsoring CC in US, what is the expected time of an application process?

Hi Everyone:

I am a Canadian Citizen. My boy friend is a GreenCard holder in US which he got almost a year ago. I want to know if he sponsors me as spouse then how long it will take for me to become a Permanent Resident of US.

Also, wanna know if I will be authorized to work on HIB in US during my sponsorship period.

if you don't get h1B and just stay in canada and wait for I-130 to be approved and for a visa number to be available - about 5 years.

If you can (independently from your immigration) get H1B -- great for you! Of course, you can come here and work.

If you husband to be becomes USC in the meantime, your immigration timeline will improve somewhat.

Thnx for your response. So, are you trying to tell me that if I get marry to a US Citizen then the application processing time is much lesser. If yes, usually how long it takes in that case? But if I will get marry to a Greencard holder then it will take 5 years approximately?

yes, if you marry a citizen, you have to wait for a lot less (because there is no quota on the number of visas for USC spouses, while you have to wait for a quota for GC holder spouses for about 5 years). But since your husband will not become a citizen for another 5 years or so, you should apply now while he is still just a GC holder.

your category would be 2A, and right now people who applied prior to April 2000 are getting their immigrant visas.
