GC holder marriage to foreigner

If a legal permanent resident was to marry a foreigner whilst they were in the usa. Can that person remain in the USA whilst the petition was filed and they waited for a visa number to allow them to change status?

If so how long can they expect to wait?
 
Wait for LPR spouse is currently reported as 5-6 years.

The spouse must maintain own status until that time. Illegal stay is NOT forgiven for LPR filing.
