I need some credible info regarding helping my husband remain in the US after he is out of an F-1 status.
I'm about filing an I-130 for my husband who has about 6 months left on his F-1 status. Will anyone be kind enough to tell me if he will be eligible for an employment authorization once the I-130 gets approved?

He is not eligible to receive employment authorization unless he becomes eligible to file for adjustment of status. He will have to wait approximately 4 years before he can receive an immigrant visa or adjust status to a permanent resident.

He comes under Family category F2A which is backlogged to June 2007. Which means only those who filed before June 2007 can receive an immigrant visa or adjust status.

As a student just graduating, what will the degree be in? Can he find a job that would qualify for an H1-B visa? If he can, then he could extend his work authorization for up to 17 months waiting on the H1-B... Has he exhausted CPT as part of his studies? Lastly, how close are you to naturalization?

He is currently rounding up his master's in pharmacy administration and has received a pharmacy intern license. He has not used his cpt or opt but it seems like getting work is harder by the day for an F1 student. My naturalization is still some years away- got a GC in Jun '10, been in the US since Aug '10.

From your signature, it appears your green card was through the DV lottery. Is that correct? Did you marry after obtaining your green card? If not, things could get REALLY COMPLICATED.
