GC for Project Manager

Hi,
My H1B visa expires Nov 2004. My company has started with the paper work for my Green Card. We have been adviced to go via the Regular LC. The position is a Project Manager's position. I have been adviced by my lawyers to not include the last 2 years of experience i have had with my current company because of complications that it can cause.

Now having said all this, i have been told that Project Managers are pretty easy to come by and it is going to be difficult proving my case. I, however, feel that my job requires me to utilize my past experience in software development, testing, etc in the current job and that is what we (boss, lawyer and me) feel will be my best bet for getting this through.

I would like to know if there is anybody out there in a similar position or if anybody has any information on how successful such cases have been. Will greatly appreciate it if you can share your experience here.

You can oinly require skills that are the MINIMUM qualifications that the company will accept for the position. If the company hires Project Managers with no experience in the underlying software, it is not a job requirment. That's why you can't use the experience with the sponsoring employer. You did not have the experience when the company hired you so the company now cannot claim that they never hire anyone for the position without the experience. They hired you without the experience.
 
Well part of that is because we are now getting into projects that did not previously need that skill set. The company will now be looking for atleast 1 more Project Manager with that skill set and my gut feeling is that they will not look for another H1B person.
 
You certainly can make the argument to DOL/SESA. Who lknows, they may even believe it and approve the LC. It is possible in some circumstances but it is just difficult, and there is a much higher probability of denial. If denied, you will have wasted several years in processing it. The benefits, and risks are yours.
 
Just so i'm getting this information clear, we are not going to use my current experience with the sponsoring company. We are going to use my past experience with the underlying responsibilities and technology for a position that has come open in the last 2 months. I'm restating that because i think i wasn't very clear in my first post.

The position title is Project Manager but the responsiblity is slightly different (vis-a-vis the technology) from the other Project Managers that are currently employed. It is not a position created exclusively for me. There are 2 such positions and i will be filling one of them.

Unfortunately, my attorney has no recent experience filing application for a Project Manager position and i am wondering if there is anybody out there who can share their experience (if any).

Does this make things any different Jim? (BTW thank you really for your honest opinion).
 
Probably possible. I would argue that all project managers require some experience with the underlying technology (if it is factually possible to make this argument).

If the title is changed to Project Software Manager or Software project manager or SAP/ERP /IT Project Manager ????
