GC Denied, then RFE, now Interview

Hey guys,

This is what has been happening:

I called up IIO in March of this year, and was told my GC had been denied. This was at the Vermont Center.

Then, after I sent letters to the Center Director and Senators, it turned out that they would be sending me an RFE.

They sent me an RFE asking for the Medical Exam. I had been waiting for I-485 for over a year and therefore my results had \'expired\'.

On July 30th, INS Vermont received my RFE. On Nov. 2 the recording got updated to "your case has been transferred to San Jose" (this is ok since I had moved to california) "and they will schedule an interview which could take several months".

My questions are:
1. How long after the transfer does the interview take place?
2. Should I be worried that they have asked me in for an interview? My GC is being sponsored by a compnay that I have not worked for recently, but will join after the GC.

INS will take similar amount of time to schedule your interview as it takes to approve a pending I-485. INS will honor your original PD, RD and ND and handle your case appropriately.
But again.....anything is possible.

Got my interview notice for the end of this month. Case transferred in May to the SJ office. Look for the word interview on this board and you will find lots of information.

A great source of information is Ciba\'s site @ http://www.geocities.com/ciba_2/I485/WebCSC.htm. Select the \'Personal\' link at the top and then item 2 on the main page (local office interviews).

The interview will be scheduled sometime at the latitude of the local office. \'Sometime\' can be in 2-3 months in SF and another lucky office in LA or 8-11 months in SJ. I have been waiting for 4 months.

You get an interview notice 2-4 weeks before the interview.

Sometime married applicants need bring proof that their marriage is bona fide. Also if you have ever been arrested you need to bring relevant documentation. If you have been member of the communist party you need to justify that aspect of your life. If you have used AC-21 to switch jobs you need of course bring documentation. If your finger prints have been rejected (too) many times your case will also be transferred.

It seems that some cases are transferred just for quality assurance, what ever that means.

Overall only a small percentage of cases are transferred. It seems that the number of transfer cases increased in recent months.

Most of the EB cases w/ interviews are approved - I have not heard of any rejected. Investor/refugee cases seem to be less lucky.

Some offices (SJ) may stamp your password at the end of the interview. Others (SF) send you home and communicate their decision in writing in a couple of weeks.

Don\'t despair, other people are in the same situation. FB applicants wait for 2 years for the interview.

Thanks for your reply. It seems to suggest that the INS at San Jose will treat this like almost a new I-485 application.

All the Vermont center needed to do was to look at my RFE response and validate that my wife and I are in good health. Instead they have transferred the case to San Jose.

Does the fact that I RD on my 1-485 is March 2000 matter at all or is it just in a queue of interview people now? Is there any way to validate that SJ actually received the file from Vermont (I would hate for this to be lost in mail!!!)?

Can I apply for advanced Parole now?

How did the INS know you moved to San Jose?

Did you tell them? Please answer this.

The queue to interview is unfortunately a seperate queue
and I don\'t believe your RD will matter much there.

However, the work on your case in Vermont will not be lost.
The interview is the end of the I485 process.
By the end of the interview the officer will usually tell you
that your case is approved or not. Sometimes, they will
say that they need to discuss it and get back to you in a few
weeks.
Either way you will receive a decision soon after the
interview.

Interviews are triggered sometimes for QA purposes,
but usually because something doesn\'t make sense.
For example, one person on this board reported
they got asked for an interview because the company
name on their pay stubs did not match the company
name in the I485 as the company had changed names.

How the INS found out was

I applied for the I485 a long time ago.

Then I moved and I let them know my address for further correspondence.

I do not know if you are asking this question because you have moved without changing your address, but I would tell you to update it in their database, especially if you have moved out fo the region.
