My marriage isn't working out and heading towards divorce as my wife is literally cheating on me. I did everything in all good faith but can't help anymore. I came to US in April 2010, so I think I can file for ' GC Conditions Removal' around Dec2011 (90 days before expiry of 2 yr period)

1) If I get divorce after filing, will I still be able to remove conditions based on my present marriage
2) If I get divorce after completion of 90 days period but process still going on ?
3) Also I am planning to go out of US for like 4-5 months . Does it matter when I should go, seeing all this
4) If at all my divorce happens before Dec 2011, will I still be able to easily prove that my marriage was genuine or its just a 'luck' thing. Only documents I have is marriage certificate, joint bank accounts, name in rental lease

you should prepare lots of photos, affidavits from non-family members...preferably someone like a pastor or a judge, someone who is "respected in the community", etc etc. also, i wouldnt go out of US for more than couple months before i get my 10 year GC. and you should apply for reentry permit if you are planning to go out for that long just to be on the safe side.

90 days before the April 2012 anniversary would be sometime in January 2012, not December 2011. If you file in December they'll reject it for filing too early.

Hi Jack/Polar

Thanks a lot for your response. Can you please answer my questions 1) and 2) above ?
Also if I plan to go out of country for less than 6 months, what will be the safe period - After filing for 10 yr GC or after getting it ?

Thanks a lot for your response. I know its not in my hand if and when my current marriage can end. We went to a counselor today and now we have decided to give another chance to our relation.
But after what exact period, I need to seek 'Removal of Conditions' on my own basis (without involvement of my wife). I think even when you go to the interview, both of us need to go. So basically even if divorce happens few days before I actually get 10 yr GC, I have to re-contest it. Please correct me if I am wrong

John_2011, it sounds like you are heart broken after your wife cheated on you. That sucks... Sorry for enduring the pain.
Now lets get down to business:
1. It sounds like you talked with a counselor and decided to give the marriage a chance... Give it a chance. Over 65% of
marriages deal with infedility at some point. I know this is easier said than done, but give it another chance.
2. Its not easy to remove conditions after you divorce. There is always the risk of being suspected that you marriage was not
bona fide resulting in denial.
3. Stop focusing on divorce. Focus on fixing your marriage.
4. Even if you get your 10yrs GC, obtain re-entry permit if you are going to be out for more than 3 months. Hopefully, you will take your spouse with you! Leaving your spouse behind for 4-5 months might destroy your fragile marriage.
Good luck buddy...
