gc based on prospective employment

Hi all,
I have a question regarding prospective employment. I was working for Company A and they started processing my GC. After I-140 got cleared, I took leave of absence for some family reasons and they resumed processing 485 based on prospective employment. If I join another company B with the same job description, can I use the AC-21 and show company B's emp letter or still I have to produce letter of prospective employment from company A at the time of emp RFE/GC stamping?

Thanks in advance.

If you left company A 180 days after filing I-485 you are no longer dependent on them for GC. All you need is a propective empolyer with a permanenet job offer with sinilar discription to the one in your LC/I-140

i have 2 doubts.

Do i still need to file AC-21 ?
Is Current emp letter from comp B enough?

There are two opinions on whether you voluanteer information to CIS about the job change or should respond only when the ask you for an employment verification letter. Either way you are ok if you satisfied the conditions mentioned in the previous post. I reccomend the second option. You may also change the attornery if the former one no longer supports you.

Hi
i am not working rightnow. When I get an RFE/Interview, if comp A is not willing to give me the emp letter, is it okay if I can get a letter of future employment from a startup company which has only 10 employees?

Thanks.

It may be OK to get a future employment letter from any company. But it could be a problem if they ask for current paystubs. I think right now you should use all your resources to find a job.

If you get a RFE for paystubs while you are unemployed, you should consult a good attorney as this is a tricky situation and needs to be handled carefully.

Good luck.
