GC Approved !!!

Hi all,

My wife and my I-485 case was finally approved on 05/05/05 ;) It's been a quite a long journey as my GC experience started in 15th March 2001 and finally got ourselves into I-485 approval stage after 4 years and 2 months of wait.

Please see below for my details:

EB3, RIR, Non Concurrent,No RFEs :
PD : 10/15/2001
I485 RD : 12/15/2003
I485 ND : 12/18/2003
EAD1 : 01/26/2004
FP1 : 05/14/2004
EAD2 : 01/06/2005
AP1 : 01/06/2005
I485 LUD: 05/26/2004
I485 Approved ..... 05/05/05 - Lucky Day :)

One more case that's supporting the argument of processing based on PD rather than ND !!

Chicagobull == were you from one of the retrogression affected countries (even though your PD is much much older) ?

Am trying to see if this PD based processing is done only for retro affected countries' EB3s or for all EB3s.
 
I don't think that 485 processing is done based on PD.
Chicagobull's case was never retrogressed.
Its always based on the ND.
But, cases are never aducated in the right order.
There is always cases being approved prior to some cases filed much earlier.

defleopard22, I believe 485 processing is done based on PD (first) and then based on I-485 RD. Let me give an example comparing my case and my friend's.

My Details:
PD 10/15/2001
I-485 RD 12/15/2003
I-485 APP 05/05/2005

My Friend's Details:
PD: August 2001
I-485 RD April 2003
I-485 App 03/30/2005

Both are in EB3, Non Concurrent and Retro affected countries. But mine got approved approximately two months after his approval.

Please note the difference between my I-485 RD and my friend's there is a difference of about 8 months. But still I got mine approved 2 months after him which is inline with our Priority Dates.

Note: This is only my opinion and observation and NSC Procedures may vary than the above.

From all of the approvals that I see here, it does look like NSC bases its processing on PD.
If they are going by ND, then a Dec 2003 case should not get touched now (I think the official processing date is Jan 2003).

But yeah, I agree there is no real pattern that NSC follows --- that's why am trying hard to find one :)
