GC approved in 5 months

Although it was a short trip since paper submissions to approval, I want to clarify that it took me 18 months to put together all the papers the lawyer requested.

Here is my story.

I am an MD from Argentina.

JULY 1994 - JUNE 1998: J1, wife and daughter J2. I should clarify that in 1996, I was out of status for 100 days. A program director screwed-up my papers and left me out of status for a while. Left the US, went to Embassy for stamping. Consul was mad but gave me another J1. I though this would really screwed my chances of obtaining a GC or leaving the country after GC submission.

JULY 1998 – NOVEMBER 2002. Moved to Argentina. Paid my two-year J1 rule.

NOVEMBER 2002. Came back to US in an H1, good until August 2005. Worked for the government, a VA hospital.
SEPTEMBER 2003. Spoke to lawyer about applying for GC. Gave me a long list of things to do. It took 18 months for me to gather all the data.

APRIL 2005, concurrent filing. I-140 for EB1 and NIW + I485. RD was 05/05.
I-140 EB1 approved on 06/01/05. FP on 07/08/05.

JUNE 2005, requested premium processing for my H1 renewal. In July went to Argentina and had it stamped. New H1 now expires on 2008.

AUGUST 2005, RFE for NIW (diploma translation). RFE sent.

SEPTEMBER 8, 2005. Emails from USCIS: I-140 for NIW approved. I-485 for me and my daughter, approved. Wife’s is pending.

Questions:
1) Should I do infopass and have passport stamping or wait?
2) How long for GC to arrive?.
3) Any ideas when wife’s will be approved?

Thank you all for your support.

That's not 5 months, that 4 months! Wow.

They seem to be sending the actual cards out pretty quickly, so unless you have travel plans in the next month or two, I would wait it out.

2) How long for GC to arrive?.
Some people have gotten them in a week or so, others take a couple months.

3) Any ideas when wife’s will be approved?

It could be very soon, or very far away. If the name check/FPs have cleared, she'll probably be approved shortly. If she is stuck in "name check oblivion", then it could take a long time.

I would call VSC and ask what's going on with your wife case. If it's a pure "mechanical" separation of cases, your call may facilitate her approval since you are the principal applicant and you are approved.

The best of luck!

dewey_daniel,

1) Should I do infopass and have passport stamping or wait?
--- Yes. Get infopass appointment and stamp passport.

2) How long for GC to arrive?.
--- It can be from a month to six months.

3) Any ideas when wife’s will be approved?
--- You may inquire about her case at the time of your passport stamp and get immigration officer opinion. Simaltaneously you may send expedite request to USCIS explaining them that primary approved and dependant still pending and stuff like that....

Good luck.
