Hello may be this Q has been asked many times but i will appreeciate if someone help me to figure this out.

I am currently on B1/B visa and will be leaving the country by the end of the october 2010 which means i stayed in the US for 5 months during during this visit. I just wonna know can I apply again for the visa this december for just 3 week visit in January 2011?

thanks

Triple Citizen thank you very much

Is it right that you cant stay in the US for more than 6 months in 12 months period? For clarification here is my visit history during 2010

January 2010 (4 weeks) although i applied in december 2009
May 12-June-July-August-September-October 2010
now i am gonna aplly again for about 3-4 week visit in january 2010

So it means i stayed in the US for about 6 months and 2 weeks during the year of 2010.

BTW i am a foreign medical graduate from Eastern Europe and can provide all the documentation about my frequent visits to US at the POE or at embassy in my home country.

There is no law stopping a visitor from spending more than 6 months in a 12 month window in the US. However if this patern becomes regular, it raises doubts about whether this person is a genuine visitor or someone who is living in the US.

You should be ok for your visit in Jan 2011. Just do not make this a habit.

thanks Triple Citizen

it is not in my interest to stay in the US for longer periods, you know if you dont work here life could be extremely expensive.
