Gap Between Renewing Ead

:confused: I have my I485 pending since RD 05/02/02 (transferred to NYC 09/23/2003). My second EAD expired on 06/23/04, I had previously applied (35 days ago)for the third EAD (in NYC), they called me for Biometrics, but did not received the 3rd EAD yet.
Is there a problem? I was confident they would issue the third EAD, it is just a matter of time..any ideas?
I just hope they will not come up with the idea of delaying my I485 case (RFE) for not having an EAD issued yet.
 
it is advised that you apply for EAD renewal at least 90+ days before expiry of current one. It is taking any time btw 2-4 mths for EAD.

90+ days is imp as on the 91st day you can go to tha local office and get interim EAD. Please stop working till u get new EAD, else it would be unauthorised work

Thanks for your reply. Unfortunately I cannot afford to stop working.
This is my 14th EAD (one might easily say I should have been more careful, but I had more important things going on during that time).
In the past, whenever I received late a renewed EAD, it was dated back, so that there was no gap.
I hope it will be the same situation now, otherwise I have no other option.
 
well, you cannot afford not to stop working as that would make it illegal. My advice was based on the CIS position from various memo's. U make ur own decisions. or consult a lawyer

If it comes up during an RFE, could you not invoke a 245(k) waiver?

Well, you are perfectly right. I have already applied under 245i.
My case is complicated enough, I cannot even start worring about the 3rdEAD renawal delay based on I485...and my 14th EAD since I came to the US...
It also looks like there is no logic in their actions: so many sets of fingerprints and EAD renewals can only make their work even harder. For each case they need to spend extra time and effort doing and redoing the same thing.
There is also no link, shared information between I485 department and I765. Instead of using my fingerprints and pictures from I485, they called me again for the same thing for I765-EAD renewal.
I understand the name check against their lists has to be renewed, but why so many sets of fingerprints? And why does the EAD expire every 12 months, when the I485 takes 4 years and the EAD renewal takes 4 months?
