NSC to VSC
New Member
After a little over 4.5 years, our cases (my wife and myself) have been approved on March 24, 2001.
Here are my details. You pick my ND, because I am confused (see below).
Regular AC (started) - 8/1996
AC approved - 2/1999 (such a delay for approval due to a mistake made by
lawyer which I found after the second mistake.
see below for detail.)
I-140 approved - 7/1999
I-485 ID: 9/22/1999; ND: 10/18/1999 (The second huge mistake by the same
lawyer; Submitted applications to SC instead of SC. SC spitted
my file; I-765 stayed at SC; I-485 (-file) transferred to NC; I-485 (A-file) transferred to St. Paul, MN. This delayed the approval of EAD. After the congressman\'s intervene
EAD was approved on 3/23/2000 and NSC collected I-485 files
and forwarded case to VSC. It took 9 months for that to happen. From VSC I received a letter indicating the following:
I-485 RD: 9/22/1999; ND 6/27/2000 (my case number was the same;
LIN-00-011-5xxxx)
During the past few months, I received very conflicting answers from VSC-
IIO; Most of them said case should be processed according to my RD, but when I noticed the approval of OCT-99 cases, IIO said RD is not important and my case will be processed according to my ND and hence I may have to wait until the processing of those cases. I asked him about the significane of RD which he didn\'t have an answer for. This happend in late Jan., 2001. Finally, I wrote to the congressman again in mid February explaining the situation. I stongly argue that INS should process my case based on RD.
I got the message from congressman\'s office that he wrote to the INS in
mid March.
FP - 10/5/2000
2nd EAD AD 2/11/2001
I-485 approved - 3/24/2001 (It was a Saturday!!)
Courtesy copy received - 3/29/2001 (the receipt date in this letter is
6/27/200 and notice date is 3/24/2001)
NO RFE
I wish all the waiters good luck. I am happy to free at last. Thanks.
