Future Empoyment based GC (485) :Question

I have filed my GC ( 485) at CSC based on future employment with a company A.

I am right now working on H1 with another company and plan to start with another Company B. I still have not got my EAD.

When is the right time to join the Company A?

Can AC 21 be applied and assuming i dont hear anything in the first six months, can i join another company C with similar job, title and salary?

If i get an interview, should i be working with the future employer Company A at that time?

Any useful info would be appreciated.?

Any body with a similar experience during their GC, please post ur views.

i am little confused since u have company a b c

This is what i know

you can leave the orginal company A after 180 days

you can work for any company after that as long
as you r doin similar job doesnt have to be exact job.


salary and location is not important.

How ever is you move to a new location u need to tell INS

and that can trigger an interview.


Another thing if u get ur GC approved and u havent changed ur job u cant change for atleast 6 months

Same case as yours.
Company A filed my GC for future employment.
Working for Company B.
Lawyer says i need to join company A for sometime ( atleast
3 months) after getting my EAD. Already more than 180 days
since RD.
Not sure that it might be possible to do so.
Lawyer says AC21 might not apply to me.
In a big dilemna , what to do!!!!

The GC is filed by ur future emplyer and because of that
you have to show that you had good intention and have
to stay on after you get your GC generally between
6mon to 12months.

Even my attorney is saying similar things : To join the future employer some time after the EAD and finger priting and before the expected RFE or interview.

My attorney says that we are definite candidates for RFE or interview and so asked me to have atleast three to six months pay stubs from the future employer.

If it is absolutely impossible for you to join now, it should be fine. The case may be slightly stronger if you have shown intentions of working and showing pay stubs is one of the ways. i guess, even if the future employer provides a letter saying that the position is still open and they plan to take you in after the GC approval - that shd be working.

But i am also in a dilemma.

Have you done your Finger Printing??

Your lawyer is saying right thing. Once you have EAD (or once you becomes eligible for getting EAD), and you dont' join the sponsoring company, will be treated as "sponsoring company" has no intention of hiring your (if they don't let you join" ) or you don't have intention to work for sponsoring company (if you refuse to join). In this situation, your case will be approved only by an oversight of the adjucator. Theoritically, its a denial.

AC21 will, however, allow you to join any other employer (other than the one who sponsored you) after 6 months.

Even in this case, an "enthusiatic" adjucator may question (send RFE) to discover whether you or the original sponsoring employer ever had intention to work togather. At the time of filing, both of you MUST have this intention.

Walk carefully.

Please clarify that this while conversation is about
GC filed based on future employment.
In this case it would not apply to me and
I'll forget about the whole thing.

I assume if your current company filed GC
then you got GC
They you can leave the company the same second.
I that correct?
