Future Employment Letter - Please help!!!

Gurus, I get different opinions from attorneys. It has been eating my head for the past few weeks. PLEASE HELP!!

Labor and 140 approved with ex-employer. Now want a letter from ex-employer to file I-485. This is what they will give me.

They wont "confirm future offer of employment", they will only write as "considers smith as a candidate for employment". Is that a problem? Does it have any risk factors?

Dear Sir or Madam,

This is to certify that XXX, Inc. considers Smith, John as a candidate for a full-time employee position in the capacity of Project Engineer with the salary of $XXXXX.XX per year upon receiving approval of his permanent residence application. We trust that Mr. Smith will be a valued member of our staff.

We intend to employ Mr. Smith according to the terms and conditions of the I-140 petition and Labor Certification on approval of his I-485 application.

We respectfully request that you grant him approval of the I-485 Application / Immigrant Visa in order for him and his family to obtain their permanent residency status soon.

I am in the exact same situation. My ex-employer is filing for my 485 as well. The letter format that you have mentioned is similar to what my employer is using as well. I dont see any issues with this.

Although, just to add, my letter did not have much mention about the LC and 140, since I guess the approvals are already done and that the requirements as per qualification etc are already adhered to.
