Future employee Greencard ?

My friend has a Green Card and he opened a company(Techstar inc) in New Hampshire in Feb 2004. I have a H1 from a different company(GLTCtech Inc).

I want to know if I can apply for a Green Card from my friends company(Techstar inc) as a future employee. Techstar Inc. has no income yet.

I have already applied for G.C from my current company(GLTCtech Inc) in March 2003 but no progress yet.

Any advice or comments appreciated.

If you have a pending I485, you can switch jobs after 180 days if:
1. Your I-140 is approved. The regulations don't specify this requirement, but it is suggested as a precaution.
2. The new job is in the same as your current or in a similar category.

This option is available thanks to AC-21 (American Competitive Act in the 21st Century).

NSC as sneding lots of RFE's in the 140 stage only. If you doing a Green Card as future employee.

I know one company in Chicago, They applied GC as future employee like 6 cases. All of them got Denied

Do not take any risk, If you want to do GC as Future Employment Process please check with Lawyer before take any step
 
It may be risk.
Since this new company does not have any financial statements.
USCIS may ask about that to check company's ability to pay salary to future employee.
You didn't mention your current status and Stage of GC.
It may help other response yr query.
 
My current stage is H1, I just applied for GC but I think it will take for ever. So I think the other option for me is to see some company where I can change so that I can get atleast labour quickly. If you know of any companies where I can get labor quickly that would be a great help.

Well Gita,

Sorry to disappoint you, there are no shortcuts to success in life.

It is a mattar of chance than strategy when working with INS. You may better off finding a company that has an already approved labor and will substitute you for I140. But again that is like finding a needle in a haystack.

If this company has no financial standing then your chances of getting an I140 are next to impossible. Getting a labor is not a problem since DOL does not look at the company financials, but INS does.

However, if you find such a shortcut, please share with us. I am sure a lot of us are dying to find such a path. :D
 
As WaitinginQ said if you can some company with approved LC and substitute for I 140, would be the best thing, if you can find any.

But if you wantto start from scratch find the area where LC is fast like Chicago based company.
file concurrent OR go for CP.
Go for EB3 ( has less salary in LC then EB2)
These are the option available.
Try to work on H1B as long as you can.

Thanks for your reply. I had a question on Advance Parole.

To get advance parole what should be my stage (e.g. after getting labor or EAD do I have to apply to INS for advance parole or to which dept do I have to apply. ) Any pointers on this will be of much help for my future travel.

Advance parole is in 485 stage

Green card has three main stages in the order mentioned below:
1. Labor(what you are in)
2. I-140
3. I-485.

You need to apply for Advance Parole only when you have applied for I-485. So, no need to worry about it in the very near future. Yo should apply Advance Parole to the service center(like Nebraska Service Center), not in the local office near you.
