Fully served Underserved Area

I am working in an undeserved area with a waiver job which was recently declared fully served. I have finished my 3 years and have a contract for 3 more years. How does it affect my application for adj. of status as the new law requires to work 5yrs in an underserved area and my area is no longer underserved.

fully served term is used by USDA it simply means that they are not going to give any more j-1 waiver. These area still remain underserved on federal register and still vailed for A.OS. or NIW. Ithink this will help you
 
Pandoo did I get it wrong?

I think I used the term fully served incorrectly. The area was underserved in Federal Register when I started working.( I got my waiver through state-20 program). Now after 3 years it is not in the list any more. What does it mean?
 
you are OK

you should be fine. as long as the area was underserved when you started working. INS regulations specifically allow this. you can check out the regulations on www.shusterman.com. Click on "physician " section among the list ofr topics on the left side of the page and then check out the "physician NIW regulations". I am quoting them below

Will the Service Require a Physician To Relocate to Another Underserved Area If the Initial Area Loses Designation as an Underserved Area?

The interim rule does not require that a physician relocate to
another underserved area should the area the physician is practicing
full-time clinical medicine lose its designation as an underserved
area. The purpose of such a designation is to foster a greater
physician presence in underserved areas. The Service believes one of
the desired results of the statutory amendment is for physicians to
take up residency in these areas and become integral parts of the
community. Once an area is no longer designated as an underserved area, however, the Service can no longer grant national interest waivers for physicians to practice in that area (other than for physicians who will work in a VA facility).
 
SudhirS, Pandoo Any Ideas?

I completed my three years in Underserved area on September 30, 2001. My initial NIW was denied in 1998 before the enactment of the new law. I am pursuing the GC through LC application and it is taking a long time. Can I apply for NIW again? I have the contract with same employer in the same facility for another 3 years.
 
Yes you can

You will however need to work a total of 5 years since it appears that you did not appeal your original NIW denial.
