Full time student while on H1-B?

I am on H1B visa and intend to go to school in the USA, full time, for a master's program. Can I keep my current H1-B visa and work (almost full time) while also attending school full time (evening and weekend classes)?

One school I applied to told me that I need to switch to F1 visa if I indend to study for more than 13 (I think) credits per semester, while other school told me that I am OK to work and study as long as I keep a valid H1-B status.

What does the law says?

As long as you work 40 hrs/week and get your pay check, you can study whatever you want.

Just one thing: I am out of work and out of country for over six months now. I am still not sure if I can return to the US. I assume my status is still OK, as the firm I worked with did not cancel any of my immigration papers. Passport stamp is still good for another year. Does the status expire anyway if not at work? Thanks
