frustrated... please help

I am so sick of this whole process now. I really don\'t know what to do. Someone please advice. Here\'s my situation:
Sent I824 in eary Jan. Still haven\'t recd receipt. I am planning to apply AC140 but cannot because receipt has not arrived. The lawyer has called INS several times. Once they said that they have sent duplicate receipt. That never arrived. Yesterday they hinted, but would not give details that the case may be forwarded to Mumbai consulate. How can this be? I thought in AC140 they do not forward anything to the consulate. Anyway, they recommended to call mumbai. However I don\'t have a case number. What will I call them and do? The INS did provide a receipt number though-- EAC- XX -XXXX Can I use that and call? Also, what number in mumbai should I call. Please help.

I am sorry, my post is not going to help you........but knowing that there are other people who suffer/d much more than you brings any kind of relief to you, then I am that person.

My 824 took SEVEN AND HALF MONTHS to get cleared and I belong to Chennai, hence AC140 was not an option for me at all.....I should have got my GC 6 or 7 months ago itself.....but, as the say goes man proposes, God disposes...

I sympathize with you, but I am not even waiting for approval. All I am waiting for is a receipt to be mailed back to me. Even that has been screwed up. My approval might come before the receipt!
 
Dont wait just send your papers ot Mumbai Consulate

I am also in the same sitatuion. I have applied for I-824 in late Feb,02 and waiting for receipt. Hopefully I should get it by next week. Once I get the receipt I will send my papers to Mumbai Consulate directly.

I recommend you to send your papers to Mumbai COnsulate without further wait, if you want to go this route.

so you think I should\'nt wait for receipt? I called mumbai consulate last night and told them about the screwup - they said that receipt is a required document and that the officer who checks your documents will not accept P3 without receipt. This guy I talked to was an Indian person. I don\'t know if he has complete info. What do you think? anyone else in this boat?

I-824 Receipt required for AC140

Because consulate needs a proof that you have definitely made up your mind to change from AOS to CP. many people try both routes of AOS and CP and that causes problems. so consulates accepting AC140 started required I-824 receipt notice.

do not sent AC140 without the receipt notice (I-824)

Shri Ganesh Thanks. I don\'t know what to do though. The INS said that they have sent the receipt but we have not recd it. They are refusing to send out a duplicate receipt. Should I just file I824 again? will that screw up things? please direct. Thanks
 
Can you get Receipt Number on INS letter

May be request them to give you the number on a letter, if they do not issue duplicate receipt number. I think you should get some proof before you send your papers to Mumbai Consulate
 
got thru to INS

Ok - here\'s what I did. I probably shouldn\'t have but I did. I posed as my employer\'s HR rep and called the INS and asked them about my case. Apparently the I824 had been approved and they have sent the notice. Now can I include the actual approval notice instead of the receipt and apply AC140 ? or do I now have to wait and do the whole NVC procedure. Please advice soon.

Confirm from attorney

I think if you had your I-824 receipt you could still send it to Mumbai Consulate directly but after you get your approval notice I am not sure you can do that. Confirm from your attorney.

Which Service Center your I-824 was filed?

my I824 was filed at vermont and I will be sending P3 to mumbai where they do accept AC140. so what do you suggest? attorney doesn\'t have any idea.
 
I am not sure about your case

Since you do not have the I-824 receipt notice, I am not sure whether they will accept it. In some cases they do. I do not know the criteria of selection. After your I-824 approval your NVC choice is available anyway. You may have to spend more time not through NVC
 
Lprasad - I filed I-824 on March 7th with NSC. Any idea how long it takes for receipt.

I am also applying for AC-140 Mumbai.

I understand how frustrating it gets sometimes. But don\'t give up your peace of mind. If you lose it, then all these issues will affect the personal life.

May I suggest that you apply for a new I-140 geared for Consular Processing. I myself did the same where my previous I-140 (AOS) was scrapped for a new I-140 via CP. I got it approved well under 3 months. Well, my point is that "avoiding I-824 " (ammending the petition) is a safer route. My lawyer advised me to do exactly that.

It may not be too late to apply for I-140 (which is straight forward I suppose you can file it yourself) and at the same go after the I-824.

Stay in Man! You will get there.

thanks for the advice. now my case has another twist. I called the INS and they said my I824 has been approved. So now can I send P3 with I824 approval letter but no receipt??
