From which date does the 6 year period start?

Hello,

I am confused regarding the date from which the 6 years limit for the H1-B starts.

Could someone please explain the rules to me.

My current situation is the following:

My first I-797 has the following info:
Receipt date: September 16, 1998
Notice date: October 21, 1998
Notice type: Approval Notice, Class: H1B1, valid from 10/01/98 to 10/01/01

My first visa stamp (in my passport) has the following info:
Issue Date: Nov 6 1998
Expiry date: Oct 01 2001

My entry date on the US territory is Nov 8 1998.

So when do the 6 years start?

H1-b clock starts ticking the day you stepped into US.

In your case, H1-b clock started ticking from 11/8/1998 and your 6 yrs cap will be ending on 11/7/2004 + days out-of-usa during this period.

Assumikng that the time out of the US is "meaningfully interruptive" of your H-1B stay. More and more frequently, USCIS is taking the position that vacation time outside the US is not "meaningfully interruptive."
