Bingaman Amendment just passed... are we all royally screwed (again)?

The Bingaman amendment caps EB immigraiton to 650,000 including dependents. 30% of EB is being allocated to unskilled, leaving 70% to EB 1 through 3. That totals 455,000 versus the current 140,000. We still got something pretty good out of this.

Thats a pretty good number.
So how long will it take for this new proposal to finally take place? 2-3 months ?

So, why was IV opposing this amendment???????

gcstrat,

Good point. From what I read at IV it seems that this amendment does away with the provision of not counting dependents towards the EB cap. It would have been more favorable to have an increased number of visas and not count dependents. However, this amendment is not the end of the world. Thats what I think.

Is this bill counts spouse and dependents against cap??

If this is, then that is not good enough. otherwise we are OK.

I wonder when house will start work on it and I am not sure house will react to it.

There's one thing I can't understand here. It seems to me that there are a lot of people who are unhappy unless they get exactly what they want from the current reform debate. Remember that the politicans in this country represent different opinions across huge ideaological gulfs. Yes this ammendement doesn't give us exactly what we want, but for them to give us everything we wanted would have been giving away the keys to the kingdom and they just can't do that!

So I am happy with any gain including this one, which increases by 225% the amount of visas that are available to EB petitioners.

Bingaman Amdt. No. 4131; To limit the total number of aliens, including spouses and children, granted employment-based legal permanent resident status to 650,000 during any fiscal year.

So..650k includes spouse and children.. But Any increase is good for us. This should help all the retrogressed countries to a great extent.

Pardon my ignorance

Guys..
Pardon my ignorance..
So as this amendment has passed . What will be the next step?
I am assuming this will be presented to the house? How long does it take? I am sure 2-3 months for it to get approved IF THE house decides to show some mercy on us LEGAL folks. So would it start reflecting on the numbers immediately..

So this is 4 folds increase, not bad.

Yooklid,

I totally agree with you. At this point, any increase is a positive for us. We need to be realistic in our approach here. Opposing every amendment that doesn't give us exactly what we want is a waste of time. If we keep protesting these sorts of amendments we will lose credibility when we truly have to oppose a bad amendment that causes a lot of harm.

What is all the fuss?

I have to agree with Yooklid. There are TONS of personal beliefs going into this debate, and with the lack of confidence the American people now have in Congress and the President, as seen through current poll stats, who knows what the right decision is!?

I say "make it stop" because I'm tired of hearing everyone's story on the special treatment you should get. Im also sick and tired of hearing stories of being moved to the top of the list based on things like SUPPOSED technical skills or capabilities, or being from a particular place. The majority of people that get in the door through these avenues dont even perform to this promised level of expertise.

The recent bills that are up for debate have me baffled-what about the people that have been waiting patiently in line and following every procedure, as per the law!? They should be stuck AT THE END OF THE LINE.

Beyond that, first come first serve-i.e. you should NEVER be pushed back in line. I also say that everyone that is worried about the changing numbers and whose family members should be automatically counted, that's a different debate-still should start with first-come, first serve.

There is also the option of serving this country in the armed forces. If you really want to be moved to the front of the line, Congress should make people get off their rear-ends and do something for this country, not expect to have it handed to them on a silver platter or based in some non-existent skill set.

Reconciliation

If the Senate-House differences are not resolved till August of this year, they won't be resolved till the NOV elections.

And after the elections, which politicians wants to "touch" "live hot button" issues?

So, let's hope in the next 2-3 months, they hammer out something good for the LEGAL immigrant community.

Bingaman amendment ..

Here is what I read at immigration-law.com

An Amendment Negative to EB Immigration Passed Today

The Senate passed today Bingaman amendment to limit the total number of EB aliens including spouses and children for the EB-based green cards be limited to 650,000 during any fiscal year. The original bill was to exempt the spouses and children of the EB immigrants from the numerical limitation and principal EB immigrants number was proposed to be 450,000. In a way, these two proposals remain intact, provided that the spouses and children can indirectly restrict the total EB numbers available for the EB immigrants and their spouses and children.

Makeitstop??

Makeitstop

I do not think people have problem with first come first serve.
How do you define "first come"?

If you are here "illegally", then by the current US law, you DO NOT EXIST in USA.

So, all the LEGAL immigrants who LEGALLY exist in the USA are already "first".

You say, "The majority of people that get in the door through these avenues dont even perform to this promised level of expertise."

And, please provide examples of 51% or more (majority means 51% or more) people are not performing upto expertise.

Please remember , most employment is "at will" basis, so if an employee (immigrant or not) does not perform, in this competitive world, he or she is USUALLY shown the door.

And remember, non-USA born citizens and immigrants form a very significant portion of advanced technology - just look at NASA.

And let's not get into the US Armed forces thing. I find it very surprising that a country cannot find among its citizens, people willing to fight for its cause and is looking for non-citizens to fight its war. USA has $450 billion dollar defense budget, more than the defense budgets of ALL countries in the world. Still, it cannot find people !!!

Also, BTW, our tax dollars are also funding the USA defense budget, not to mention social security and medicare.

Not to mention money from our investors and governments which is funding the 9 (NINE) TRILLION DOLLARS deficit of USA.

Just look at what has happened to the US DOLLAR - a depreciation of 40% in the past 5 years.

The FACT is USA needs people like us and in another thread, I had indicated in future, USA will need more immigrants because of its aging population and low birth rates.

I think IV are con-men. They did not seem to know that this Biingham Amendment would be voted on.. and now passed. So now they are trying to claim victory and demand contributions on their site... using the red herring argumnet of "Managers' Amendment" which IV claims "sources" have told them includes Brownback amendments.... These guys should stop fooling the intelligent people on this forum and fire their lobbyist.

Reveal you "sources" in the Capitol who are feeding you garbage info and wise up

I suppose the 650k cap from Bingaman would be bad if future families are composed of 10 kids per family!!! But seriously... on average it's like 3 people per family so:
650000 / 3 = 216666 cap... assuming each applicant has a wife and one kid.

So it's a 50% increase on overall EB cap, I guess???
