Hi all,
My brother-in-law, unmarried and over 21, has a petition from his Mom (my mother-in-law) filed in 1999, when Mom was still a Permanent Resident, so it was filed under F2B category.
In 2004, Mom became a US citizen, so brother-in-law's petition was "upgraded" to F1 category (unmarried son/daughter of a US citizen).
However, for the Philippines, the F2B queue actually moves faster than F1.
My (perhaps a stupid) question: can brother-in-law file for AOS (he's on H1B right now) based on the visa bulletin for F2B? USCIS is processing priority dates of 1998 and earlier for F2B now, while F1 is at 1993 yet (Philippines).
