From EB3 to EB2

Guys,

My case is effected because of the general retrogression of Priority dates for EB3 category. But except for 485 approval, all the other formalities are done on my case.

Because of my eligibility, my attorney wants to apply for 140 again in EB2 category and assign that 140 approval to the exisiting 485 application.

Is this a good idea? What could be the repurcations of this change? Please share your thoughts.

I never heard anything like that before, can we just file a second I-140 and use it for pending I-485? BTW, what are your case details?
I think luck matters more than anything in GC processing, I and few friends of mine who are also in EB2 still didnt get approvals inspite of no raodblocks.Whereas few other that I know in EB3 got approvals within 6 to 9 months of I-485 filing(some of them in retrogression effect). Just try your chance! Goodluck.

Yes, the LC is a qualified EB2 one. But by mistake they applied the 140/485 in EB3 and at that time it didn't matter as all categories were current.

One was Feb 2002 but he got approved sometime just before or after the dates retrogressed to Jan 2002. May be their case was almost adjudicated.
Another was in 2003 PD.
One EB2 of a friend PD Jan/Feb 02 and ND Nov/Dec 03 is still waiting.
I dont know about couple of others.
