Friends please help: Re-entry to United States; pending I-485

hi friends,

I really need all of your help/suggestions.

I applied for I-485/EAD/AP. I got my EAD/AP also. Recently I got
my H1-b extension approval also.

I am going to India for 2 wks vacation, for my marriage in Last of Dec.
Next week i am going to Mexico to get my visa stamp so that I can
travel to india and comeback.

For any of the unexpected reasons if I don\'t get my VISA at Mexico and
if I drive back to USA with my valid i-94 ( no visa ), will there
be any problem to my I-485 processing ?

[ I will be in india for just 2 wks so i don\'t think that\'s sufficient
time to get it stamped, so travelling to Mexico ]

Any help/suggestions really appreciated.
 
Why do you want to apply visa?

I can\'t understand why do you want to applyu H-1B visa stamp?
as you mentioned in your message you got your EAD/AP. Why do
yo uintend to use these documents for you travel and work?

I recently went to India and came back on EAD and AP, no need for the H1B visa or new stamping. If you have EAD and AP thats fine, again find out from your lawer.
 
guys...his problem is different...

he is going to india for getting married...once he does that he probably wants to get his wife here on H4...if he uses AP for coming back to US...he will be screwed....his wife cannot come to US then on H4 and will have to wait for a long time outside US....in the line for family immigration....I guess that\'s why he is so desperate to get his H1 stamped so that he can use it to travel and later on come back to the US....I would advise you buddy to talk to your attorney...before taking any steps......and make sure things are right before going to India...

I am having EAD/AP but I don\'t want to use them to get into this
country.

I need to get H1- stamping, so that I can bring my wife to usa on h4.

The thing that I am interested to know is, if I enter into USA without
a visa stamp from Mexico in my passport will that create any problem
to my current I-485 process ?

Observe:It\'s leaving country and entering with a valid I-797

( if i don\'t get my visa in mexico then after returning back from mexico I can apply at St.Louise but will it create any problems to
my current i-485 process ?? )

any help/suggestions appreciated.
