Hi,
I need your valuble suggestion/experience. My ND is for I-485 was: 01/16/02 and my attorney say's , i may get within two to three months. My Client offering me a job of 62k, my labor say's 36.9 /hour, which is 73k(i think), but i am going to get good benifits such as 15% of profit sharing + 5% of yearly bonus + medical + 401k. with same duties. My question is as salary difference is there , is there any problem if i join a client? If you comibine all the benifits as i mentioned the salary will become same. please adivse( it''s urgent):confused:
 
Some lawyers have opinion that by "same or similar job" INS means "atleast same salary and same or similar job code". Others say that as long as the job is same or similar in duties, it should be fine regardless of the salary (which makes lot of sense to me because salaries in lets say Texas are lower than California... for same or similar job) .

Since INS has not bothered to come up with regulations in this regard, no one can say emphatically that you will be OK or you will not be OK.

Initially INS was in opinion that as long as the salary is above a "public charge" threshold, it was ok. But, as the economy goes into deep recession, they are increasingly asking for paystubs to show salary atleast equal to as mentioned in labor.

Its a shame.

Talk to a lawyer before making a move. To be safe, try to talk to your employer to reduce your bonus + profit sharing and increase your base salary....
